second class b misdemeanor?

Hey guys this is the last time I’m going to ask this question seeing as though my sis court date is tomorrow.well she was on deferred ajudication for theft a while ago and completed the terms with that.but she got caught trying to steal from walmart 60 bucks worth of things.the offenses were in two seperate counties and I have 2 questions 1.would this county be able to see the past offense, and 2.what kind of punishment should she expect? This is in texas by the way

In the State of Texas a deferred adjudication that is completed results in a dismissal of charges OR a finding of Not guilty. If your sister completed a deferred period through the court the first misdemeanor charge should not count against her during the second trial– HOWEVER, the prosecutors and judge will know that she has been arrested for a similar offense but that those charges were dismissed. If she is trying to avoid jail, she might want to have her attorney approach the Prosecutor about a plea with community service and fines or something along those lines. ‘B’ misdemeanor theft in Texas is not a terribly huge deal, but it will affect her ability to get a job later. Even if she is convicted, she will serve time in county jail, not a state prison.
Talk to her attorney or the public defender and find out what’s usual for your county as far as plea bargains to this sort of offense.

she is in big trouble and will go to prison! her past offenses will! be used against her, because she has not learned and will be repeat offender, so will do some pretty good time

The court will be able to see her past record.
She can expect some jail time.
